Feedback from EduQual The evidence presented by the learner is nonsensical from the start. The learner states ‘…family-owned businesses or general partnerships such as the case of Wal-Mart…’. Walmart is the world’s largest company by revenue, with US$514.405 billion, and the largest private employer in the world with 2.2 million employees has 11,389 stores and clubs in 27 countries, operating under 55 different names. To suggest also that ‘Warner Bros represents limited partnership type of company’ is equally absurd. The learner also has very limited understanding of the vast functionality of Google, commenting only its search engine function and ‘products and services’. The learner clearly has no understanding of the structure of legal entities. The learner also has limited understanding of the structure of a contract, suggesting that for acceptance, ‘the third party must accept the requests of the organisation’. There should be no third parties involved at all. There is no discussion of consideration as a contractual function and no mention of tort anywhere. The example to illustrate liability in negligence has been copied from https://www.thebalancesmb.com/what-is-negligence-in-the-legal-sense-398352. In the section on Different Business scenarios, the learner refers twice to p.6 and twice to p.10 of Fandl, K.J., 2016. Cross-Border Commercial Contracts and Consideration. Berkeley Journal of International Law, 34. This work focuses on a very specialist area of transnational contracts. The work has been inspected and there is nothing on either page six or page 10 that has any relevance to the evidence presented by this learner. The learner’s and assessor’s lack of understanding is further illustrated by the statement that ‘The UK is one such state with extreme trade policies’. The learner also references Dhingra et al. 2016, p. 3, discussing ‘…compromised trade agreements between the UK and other countries in Europe…’. Nothing on page 3 of this document is relevant to the learner’s evidence. The UK’s trade policies are currently governed by membership in the EU. The learner’s evidence reflects a complete misunderstanding by them and their assessor of the current situation. A pass is not agreed.
