In unit 3 you were asked to describe the State Court System for your state, Now find another state and compare and contrast the two Court systems from the different states. 2. Assume that A and B have a contract dispute and want to bring an action in state court, what are the basic procedural requirements? 3. Describe FIRAC and then use FIRAC to analyze the following case (use the Internet to find the appropriate rules of law): Material facts of the case (Facts) Issue or issues before the Court for decision (Issues) The rules of law that the judge is relying upon in issuing his or her decision (Rules) The Judge’s analysis and reasoning upon which he or she is issuing the decision (Analysis). The Judge’s decision (Conclusion) = FIRAC example: Mary and Joe want to enter into a contract. Mary wants to sell Joe her used textbooks for $100. Joe thinks that is a fair price but is not sure if the textbooks are worth $100. Mary in waiting for Joe’s response advertises the textbooks in her school newspaper. When Joe sees the ad he brings a suit against Mary for breach of contract. Mary in the meantime sells the textbooks to Paul for $50.00. What are the rights of the parties, does Joe have a cause of action against Mary and can Mary sell the books to Paul.
